De åtta som mördades, fem av dem spanska jesuitpräster och de tre övriga en salvadoransk jesuitpräst och en kvinnlig anställd med dotter.




El Salvador: I Madrid ställs två av mördarna av de fem spanska jesuitprästerna inför rätta

TEGUCIGALPA / DICK EMANUELSSON / 2020-06-08 / I dag inleddes i Madrid rättegången mot två av de utpekade mördarna av åtta personer, fem av dem spanska jesuitpräster, som mördades av en dödsskvadron från den USA-stödda salvadoranska armén i november 1989. Beslutet att avrätta de fem fattades av den högsta ledningen för armén, vars generaler hade utbildats på School of Americas i USA.

Det är den spanska människorättsorganisationen `La Asociación Pro Derechos Humanos de España´ som under tio års tid har fört en hård strid med den reaktionära spanska rättsapparaten för att denna, enligt internationell rätt, skulle inleda processen mot det salvadoranska militära etablissemanget. 

De utpekade är överste Inocente Montano Morales och löjtnant René Mendoza Vallecillos, enheter ur den salvadoranska armén som den 16 november 1989 sköt ihjäl de fem jesuitprästerna samt en salvadoransk jesuitpräst och en kvinnlig anställd på det Centralamerikanska Universitetet UCA i San Salvador som mördades i sällskap med sin dotter.

Enligt anklagelsepunkterna och enligt de salvadoranska människorättsorganisationerna utgjorde de anklagade delar av en parallell struktur inom den salvadoranska armén. Denna var en del i den av CIA och Pentagon utformade manualen för ”Smutsigt Krig” som ägnade sig åt gripanden, tortyr, försvinnanden och avrättning av vad Pentagon i sin ”Nationella Säkerhetsdoktrin” karaktäriserar som ”den Inre Fienden”, det vill säga den politiska revolutionära vänstern.

Det var denna struktur, med deltagande av ”Dödsskvadronpartiet” ARENA som mördade San Salvadors älskade ärkebiskop Oscar Arnulfo Romero. Arena uttalade under den politiska krisen och försöket till statskupp i Nicaragua april-juli 2018 sitt ”totala stöd till den nicaraguanska oppositionen”!







THE TRIAL FOR THE MURDERS OF THE JESUITS IN EL SALVADOR BEGINS

 

This culminates a process whose instruction began more than a decade ago with the complaint filed by the Spanish Association for Human Rights in defense of the interests of the victims.

 

On Monday, June 8, 2020, the trial of those responsible for the murders of the Spanish Jesuits in El Salvador will begin in Madrid, before the Criminal Chamber of the National Court. This culminates a process whose instruction began more than a decade ago with the complaint filed by the Spanish Association for Human Rights in defense of the interests of the victims.

The  Pro Human Rights Association of Spain  presented before the Second Section of the Criminal Chamber of the National Court, a year ago, the brief of accusation against Colonel  Inocente Montano Morales  and Lieutenant  René Mendoza Vallecillos , of the Army of the Republic from El Salvador, for the murder, on the early morning of November 16, 1989, of the Spanish Jesuit priests  Ignacio Ellacuría Beascoechea, Ignacio Martín Baró,  Segundo Montes Mozo, Amando López Quintana and Juan Ramón Moreno  Pardo , and the Jesuit priest  Joaquín López López , the employee  Julia  Elba Ramos  and her daughter Celina Mariceth Ramos , the last three of Salvadoran nationality.

The trial will begin at 3:00 pm in Madrid and will be broadcast live, in order to comply - in COVID 19's time - with the principle of publicity and orality of the criminal justice debates. The sessions will begin with the exposition and resolution of the recent request of the accused Mendoza that his criminal responsibility for the prescription of the crimes imputed to him be excluded. Yushi René Mendoza Valdecillos was a young officer of the Salvadoran Army when the events took place, and since then has maintained a procedural position of collaboration with the justice and reparation of the victims, for the full clarification of the facts, the investigation of the case and holding this trial.

The defendants were part of the parallel structures of the Salvadoran army that systematically used clandestine procedures of dirty war and state terrorism during the internal armed conflict in the Central American country in order to alter public peace and instill terror in the population through actions such as extrajudicial executions of opponents, indiscriminate attacks against the civilian population with firearms and explosives, enforced disappearances, torture and other attempts against the life and physical and moral integrity of people, and also against property; attacks including the 1980 murder of Monsignor  Óscar Arnulfo Romero, Archbishop of San Salvador, and successive bomb attacks on the headquarters of the Central American University, UCA, which in no case could be considered a military objective.

This chain of aggressions manifestly in violation of International Humanitarian Law, culminated in 1989 with the murder of  Ignacio Ellacuría  and his companions, decided by the Salvadoran Army General Staff, and executed in a premeditated and treacherous manner by the Atlacatl Battalion that ended the life of all victims of multiple firearm injuries.

For more than twenty years, the Association for Human Rights of Spain has been present and contributing to the exercise of popular action in the initiatives in which it has been exercised in our country, despite the limitations imposed by the successive reforms of our Organic Law of Judiciary in contravention of International Conventions ratified by Spain, the universal jurisdiction to protect victims of the most serious human rights violations and to exercise their right to justice.

After thirty years of the murder of the Jesuits in El Salvador, the APDHE reiterates its commitment to continue accompanying the victims in these cases for justice, and defending the exercise of universal jurisdiction in our courts while advocating the recovery of the legislative framework twice unduly restricted by our legislators in breach of the obligations previously contracted by Spain. In accordance with the Vienna Convention on the Law of Treaties, no country can invoke its internal law to disregard international obligations previously contracted by signing a Treaty.

The sacrifice of Ellacuría and her companions, demonstration of their unwavering commitment to the most disadvantaged, to human rights, to peace and justice, moved the entire world and continues to be a benchmark and example of coherence and service for successive generations of human rights defenders. Seeking justice three decades after their murders is our contribution to their memory.

”Åsne- och Twitterpresidenten” Bukele som ”El Salvadors Fujimori”

Bukele har "intagit" Nationalförsamlingen med krigsförberedda specialstyrkor ur armén och ber till Gud om att "Han" ska tvinga parlamentsledamöterna att ge vika. Inte ens under militärdiktaturen och kriget under 1980-talet inträffade något liknande. Respekt? Inför vem, förutom Donald Trump?

I ett år har han nu suttit, Nayib Bukele. Vald på ett högerpartis valsedel utan ens enkel majoritet i Nationalförsamlingen har han baserat sin makt ömsom med hot och med de väpnade styrkorna i ryggen som till och med, i full stridsmundering, marscherade i Nationalförsamlingen där denne politiska pajas hotade de valda parlamentsledamöterna.

Stilen påminner om fascisten Jair Bolsonaros. Och det är samma populism för appellerar till folket som manipuleras via hans Twitter som upptar större delen av ”Åsnepresidentens”, som han döpts till.

Och precis som Bolsonaro, Lenin Moren eller Mauricio Macri har ”El Presidente Burro” använt sig av CIA-manualen ”Lawfare”, det vill säga juridiska skådeprocesser som riktas mot eventuella potentiella fiender ”som måste oskadliggöras”. Förr hade CIA och dess lokala avläggare, som i El Salvador var dödsskvadronerna som hade ihjäl den ”farlige” och av folket älskade ärkebiskopen Arnulfo Romero. I dag använder sig Trumps lokala allierade sig av den juridiska apparaten. Och när Bukele misstänker att någon av ledamöterna i den rättsliga instansen inte går på hans ”neutraliserande” av domstolsledamoten hängs denne ut ”inför folket”.

Vad vi förmodligen snart kommer få se är ett ”neutraliserande” av Nationalförsamlingen och kanske också författningsdomstolen som inte går i takt med den twittrande presidenten.

Alberto Fujimori, vald till president i Peru i början av 1990-talet stängde kongressen och upplöste hela rättsapparaten i ett dekret 1992 och regerade därefter under flera år med de egna presidentdekreten. Samtidigt aktiverade han dödsskvadroner som jagade ”den inre Fienden”.

Tendenserna hos Bukele är farligt lika Fujimoris agerande.

Burrokele: My kingdom for a selfie

Nayib Bukele does not hesitate to expose his thinking with the same speed as his thumbs allow it ... social networks are the space where the President of El Salvador disposes, criticizes, denounces, humiliates and persecutes.

Twitter, par excellence, becomes its most synthetic and drastic space to let your country and the world know your decisions or appreciations.

He does not seem to understand that all his acts are political ... he acts simulating spontaneity, freshness, modernity; but none of this is left to the universe ... and if it were so, at times, it is noticeable that it is not interested.

Chance, confrontation and frivolity were and are his trademark. This reached him to reach the highest institutional hierarchy in his country.

And he already found the seductive charm of arrogance to his role of power.

He boasts of speaking to Trump as if (per se) he placed his country in the first world.

He has not hesitated to devise an attack against the Legislative Assembly agitating the violence of the security forces with total self-confidence, nor has he been undeterred by violating the National Constitution in times of pandemic.

It goes through some remarkable phrases with an apparent democratic meaning with dictatorial procedures typical of other times.

He does not hesitate to consider himself the savior of his people and in three days post that they are condemned to death ... referring that he also does not know if they do not deserve it ...

You can go from the most dramatic tweet to think of yourself as the victim of an alien conspiracy to abduct him (I don't think Salvadorans are that lucky).

He has not hesitated to criminalize social protest as pretending to govern without opposition of any kind.

And in that format of genuflection towards the USA He could not stop acquiring, within the special combo "In God we trust" , the lawfare franchise ...

And it is in Siegfried Reyes, former President of the Legislative Assembly today asylee by the Mexican government, where the hostility and legal / political persecution of the millennial president fell.

Siegfried approached the writer of this review in Cancun, Mexico. More precisely at the end of my conference on the judicialization of politics in the region and within the framework of the World Summit for Political Communication.

We immediately generate that empathy that occurs among those of us who believe in the Great Homeland and we can afford to think against certain hegemonic discourses with Anglo-Saxon whiff.

Reyes began to send me the pertinent documentation about his case and I decided to collaborate with his team of legal advisers.

The current Salvadoran government in clear collusion with a sector of criminal, civil and administrative justice as well as certain media, began the persecution following the hackneyed manual of the legal war.

The main objective: the institutional weakening that allows Bukele the sum of public power to self-crown himself ...

To do this, it was necessary to subject Reyes to countless pressures sustained over time by unscrupulous prosecutors and a majority of courtiers who collaborated to deliver the final thrust to generate his capture request. The asylum granted by the Mexican state prevented the confinement from becoming a reality, while not content with their attempt at Siegfried, they extended the persecutory behavior towards their family and their assets under the pretext of forced arguments of criminal law and criminal procedure.

Accountabilities once accepted and verified by circumspect audits and detailed crossings of economic and financial information for years came to be suspected by the country's highest judicial authority in clear contradiction. Criminal investigations filed for their inconsistencies, reopened and again immobilized due to the absence of proof of charge. Of course, now there were orders to follow, the result of surreptitious pacts, initialed in dark catacombs of nefarious power, perched on a President who has not hesitated to make visible his pressures and threats in pursuit of his strategy.

From his official account of the bird network, in July 2019, he did not hesitate to condition the Court before the imminence that the plenary votes could not send Reyes to trial, enraged, he spoke of vote 8 that would achieve "impunity" of the highest authority of the Assembly. As an icing on the cake, and for the avoidance of doubt, he coercively sentenced "The Salvadoran people will know which magistrates of the Supreme Court of Justice are in favor of impunity and who is not ...".

How did Bukele know the status of a vote, until then, secret?

How dare he advance so blatantly on one of the powers of the state?

The result was more than evident in the face of such a threat, obtaining the necessary votes to activate the civil and criminal machine against Reyes and his environment.

There would begin, or continue, the advance that at this point extended to other former officials, although it had not reached such "eloquence" as the one previously reported.

Obviously, the Salvadoran judicial system is much more than the servile partners that have decided so far and we vow, the professionals of the legal profession, that the bodies of review that are coming nullify what has been done, putting the truth as the highest good of the process; exalting the rights and guarantees of due process not already national but of international roots.

However, we are attentive to the continuity of the pressures ... there is much at stake for Bukele and his political leaders ...
